SGS Informs on Toy Safety Regulations and Standards in Indonesia

Regulations aim to improve safety, quality and competition in the Indonesian toy market. Demonstrate compliance to SNI standards and access this emerging market.

In 2013, Indonesia enacted new regulations to mandate the use of Indonesian National Standards (Standar Nasional Indonesia, SNI) and EN 71-5 to demonstrate compliance with the new safety requirements.

Compliance has been mandatory since 30 April 2014. In addition, on successful completion of the product assessment process, the SNI certification mark must be displayed on the toy and/or its packaging.

For the Indonesian market, toys are defined as products designed for children up to and including 14 years of age. The Minister of Industry has defined 12 categories of toys with specific Harmonized System (HS, Tariff) codes to fall under the scope. These include:

- Construction toys

- Dolls

- Inflatable toys

- Plush toys

- Puzzles

- Soft toys

- Tricycles

- Toy figurines

Category 12 is a catch all section, which incorporates any product designed as a toy for the 0 to 14 age group, and not included in categories 2 to 11.

Product Certification Required to Bring Toys to the Indonesian Market

Before placing a toy on the market in Indonesia, the manufacturer or importer must instigate product assessment and certification to demonstrate regulatory compliance. Applications for certification must be made to a Product Certification Institution (LSPro) who is approved by the Ministry of Industry. Sampling must be completed by personnel approved by the LSPro. Testing must be completed by a testing laboratory approved by the Ministry of Industry.

To meet the needs of the international toy industry, there are approved testing laboratories both in Indonesia and around the world.

SNI Certification Process

- Product certification can only be granted by application to an LSPro.

- The LSPro processes applications, verifies documentation and obtains product test results from an approved Testing Laboratory.

- SNI certification is granted to qualified products.

- The manufacturer places the SNI Mark on the product and/or its packaging.

Upon successful completion of the SNI certification process, manufacturers must then display the SNI mark on the toy and / or its packaging.

Toy Safety Legislative Landscape in Indonesia

To protect consumers from low quality, unsafe or dangerous toys, the applicable toy safety regulations in Indonesia are:

- Decree of the Minister of Industry 24/M-IND/PER/4/2013 dated 2 April 2013 as amended by Decree 55/ M-IND/PER/11/2013 dated 11 November 2013.

- Regulation of Director General of Industrial Manufacturing 02/ BIM/PER/1/2014 (Technical Guideline for Implementation of Mandatory SNI for Toys).

- Minister of Industry Decree 52/M-IND/ PER/10/2013 dated 1 October 2013 as amended by Decree 18/M-IND/PER/4/2014 (Designation of Conformity Assessment Institutions).

This legislation aims to improve and demonstrate the quality of toys being sold in Indonesia, as well as creating fair competition between manufacturers, delivering transparency in the way toys are designed, produced and marketed, while also stimulating innovation.
