First Nations and Land Code in British Columbia

CloverPoint looks at the state of land code in B.C and looks at the land code process

March 30, 2015 - PRLog -- A number of First Nations are moving forward and addressing the topic of Land Code.  Currently 51 First Nations across Canada are operational under their own land code with a further 61 at some stage of development. Recall, Land Code enables First Nations to govern reserve lands without interference from Ottawa. This is often viewed as an important step towards self determination and self government in that it secures control over key land management decisions.

Using a recent vote in B.C by the Lil’wat Nation as an example, Land Code can accomplish a number of important changes for those affected, including, but not limited to:

- Provides enhanced law making power and greater legal recognition
- Provides for more community input and consultation with the impacted Citizens
- Protects citizens from arbitrary expropriation of their lands
- Ensures that Nation Reserves can never be reduced in size
- Provides for a clear process for the creation and management of both third party and Lil’wat citizen interests in reserve lands.

A move towards land code is a huge first step towards a need for an efficient land management solution design to manage land assets, requests for access, lease and title to lands, and much more - we've discussed these topics at length on the CloverPoint blog.
