Landmark Case Brenner V Scott Allows iMediate Inc To Provide Mediation Services To Same-Sex Couples

A recent injunction has allowed same-sex marriage to be legally recognized in the state of Florida allowing mediator services such as iMediate Inc, to provide premarital counseling, marriage and divorce mediation to same gender couples.

WEST PALM BEACH, Fla. - March 5, 2015 - PRLog -- Same-sex marriage in Florida became legal on January 6, 2015, as a result of a temporary injunction issued by a U.S. district court in the case of Brenner v. Scott, in which the state's previous same-sex marriage ban had been found unconstitutional.

Under the old law, Title XLIII: Domestic Relations Chapter 741: Statute 741.212, marriage between two people of the same sex whether they were married within or outside the State of Florida would not be recognized for any purpose in Floria. The new injuction prevents the state from enforcing its ban allowing same-sex marriage to be legally recognized in Florida.

When asked about what happens to same-sex couples married in a state where the union is legally recognized who then move to the state of Florida he explained, "(Prior to the injuction)...that left a lot of couples in a state of the unknown. Then the first same-sex divorce came about with a couple that married in 2002 in Vermont and when the relationship ended in Florida they were stuck in a state of the unknown for five years because there was no mechanism in play (in Florida) to deal with their divorce."

He went on to say, "Issues of couples within same-sex marriages are the same issues that a man and woman would encounter which is equitable distribution of property and what do we do with the child of the marriage. Now there is actually a mechanism in place for them to get divorced and move on with their lives."

He closed by saying, "It will be interesting to see what the statistics come out with in regards to the rate of divorce of same-sex couples in comparison to heterosexual couples. In traditional marriages 50% of first time marriages end in divorce, 65% of second time marriages end in divorce and the numbers only go higher afterward. So it will be interesting to see if marriages of same-sex couples last longer or if they have the same divorce rate as heterosexual couples."
