Farmer Jaffe Weissing & Co-Counsel Presented Legal Aid Services of Broward County with Cy Pres Award

Fort Lauderdale, FL – Farmer Jaffe Weissing partners Seth Lehrman and Steve Jaffe with co-counsel Scott Owens, presented a cy pres award of more than $40,000 to the Legal Aid Service of Broward County, Inc.

Cy pres awards are funds leftover from class action lawsuit settlements. For a number of reasons, not all class members can be located to receive settlement monies. Instead of that money reverting back to the defendant, cy pres allows the funds to be directed to charitable organizations.

This award was from a consumer class action settlement with Main Street Acquisition Corp., a collection agency, which allegedly failed to maintain the registration required by Florida statute. The settlement class was comprised of approximately 1,000 Florida consumers who were subjected to the illegal collection activity.

Class members shared a $150,000 settlement fund. In addition, Main Street forgave more than $5 million of debt owed by this group of Florida consumers. To accomplish the debt forgiveness settlement benefit, the defendant dismissed all pending lawsuits filed against class members, and recorded satisfactions of judgments for every judgment entered against a class member and forewent seeking to collect any monies from class members on the subject accounts.

The claim asserted a Fair Debt Collection Practices Act Claim (FDCPA) and an unjust enrichment claim. This settlement was a first of its kind in the 11th Circuit, recovering substantial benefits for consumers under an unjust enrichment claim based on Florida's registration requirement.
