By: BAXTER My homestead came under attack in the 322nd District Court in Fort Worth, Texas. On two separate occasions Judge Berger and Associate Judge Munford ruled to have my homestead seized and auctioned off. All of this was done in violation of due process of Fourteenth Amendment Rights because I was never served. In December of 2013, I contacted my Attorney where he submitted proof to the Constable in Hood County that my home was documented by the Hood County Appraisal District as a Texas Homestead by law and was exempt from seizure. In April 2014, my attackers again approached Judge Nancy Berger. This time they submitted a Motion to Turnover where my ex-wife Briggs in a sworn statement to the court claimed I, “Defendant has not lived in the subject property for over two years. He resides outside the United States (Costa Rica) and has abandoned his homestead.’ This statement was an outright lie and Briggs perjured herself when she signed the sworn statement. At the hearing, Judge Berger shielded herself by taking both attorneys with her out of the courtroom. My attorney said the evidence I presented was overwhelming. On July 18, 2014, a written demand was made to Attorney Daniel Bacalis for Briggs to release the lien on my homestead. The lien is still there. I filed a lawsuit in Hood County (Baxter vs. Briggs) for damages and to free my homestead. A summary judgment hearing is scheduled in the Granbury Court on March 5, 2015. The defendants will attempt to remove (weasle out) Attorney Anthony Bacalis from the lawsuit under the litigation privilege. The outcome of this case could threaten the protection of the Texas Homestead for all citizens and senior citizens across Texas. It might enable more judges and lawyers to ignore the law.
