"It's pretty egregious that the mayor of a major city wants to devote law enforcement resources to the charging of cell phones, rather than to preventing serious crime," says Silver.

Metro spokesperson Paul Gonzales said the arrests were legal because the subjects are stealing and because "electricity isn't free."

The recent arrests have created an environment where both young and elderly riders are nervously unplugging their cell phones to avoid being arrested.

"This is very scary. There are a number of dangerous things that can happen when cell phones are dead and an emergency situation arises. This can only do more bad than good," notes Silver.
