Former Chef of El Born Restaurant Wins NY Unemployment Insurance Hearing

NEW YORK - Dec. 22, 2014 - PRLog -- Michael Redenburg successfully represented a former chef who worked at the El Born restaurant located at 651 Manhattan Avenue, Brooklyn, NY and who was initially denied his unemployment benefits. Following his separation of employment with El Born, the former chef applied for unemployment insurance benfits, but his employer contended that he was discharged when he was insubordinate by refusing to meet with the owner to address certain issues after the restaurant had closed.

As a result, a Hearing was requested and held at 9 Bond Street, Brooklyn, NY on December 17, 2014 before the Honorable Henry A. Sullivan. Testimony was elicited from the former chef and the next day a decision was mailed and filed. The Hearing Judge decided that the initial determination, disqualifying the claimant from receiving benefits on the basis that the claimant lost employment through misconduct in connection with that employment and holding that the wages paid to the claimant cannot be used toward the establishment of a claim for benefits, is overruled.

Michael Redenburg represented the former El Born chef and also represents restaurant workers who are denied tips and overtime pay.
