Angela Lavin is a partner at Wegman, Hessler & Vanderburg where she represents companies and individuals involved in business and commercial litigation disputes. She has litigated and tried cases in state and federal courts involving breach of contract, fraud and misrepresentation, unfair competition, shareholder disputes, trademark infringement, misappropriation of trade secrets, and insurance coverage issues.

The Advisory Committee on Rules of Civil Procedure met to revise the Federal Rules of Civil Procedure in April 2014. Civil discovery varies under US law and can include almost any material relevant to a case except that which is privileged, a product of the opposing party, or certain expert opinions. Electronic discovery (e-discovery) is used when the material is stored in electronic format.  Rule 37 addresses failure to provide information or failure to co-operate in e-Discovery. The proposed amendments to Rule 37(e) make it more standardized by using the aspect of ‘reasonableness’ to measure the degree to which entities have complied with the Rule.
