Intellectual Property Attorney William R. Trueba Jr. Named a 2014 Most Effective Lawyer

MIAMI - Dec. 10, 2014 - PRLog -- Intellectual Property Attorney William R. Trueba Jr., a founding member with the law firm of Espinosa | Trueba P.L., has been named a 2014 Most Effective Lawyer in the Intellectual Property category by the Daily Business Review, a leading source of daily legal and business news in South Florida.

Trueba was recognized for winning a major victory in June 2014 in a patent infringement lawsuit, Tawnsaura v. Vitacost.com. At stake were the financial interests of Trueba's client, Vitacost.com Inc., a Boca Raton-based vitamin and supplements online retailer, and 19 other sellers. They were the remaining defendants out of 89 companies sued for infringement by Tawnsaura Group LLC, a non-practicing entity (NPE) (referred to by some as a patent troll), over two nutritional supplement patents. The joint defense group selected Trueba and two other attorneys to argue the motion for summary judgment. Two days before the oral argument on the motion, one of the other attorneys informed Trueba that his client had settled. The other attorney’s client settled the day before the oral argument. As a result, Trueba argued the entire motion alone.

At the end of the hearing, U.S. District Court Judge S. James Otero ruled in the defendants' favor from the bench instead of taking the matter under advisement.

This victory is rare because most courts usually reserve judgment until long after the hearing. Also, in cases with NPEs, many companies settle rather than bearing the risk of challenging the claims and the underlying patent(s).

The Most Effective Lawyer Award recognizes the excellent work performed by South Florida lawyers. Nominees were evaluated by the editorial staff of the Daily Business Review based on tangible results and impact. This year’s awards recognized 95 lawyers in 15 practice areas including appellate, aviation, arbitration, bankruptcy, class action, corporate securities, criminal, intellectual property, lobbying and regulatory, medical malpractice, personal injury, pro bono, products liability, public interest and real estate. Trueba received the award at the 10th Annual Most Effective Lawyer Award luncheon on December 5, 2014 at the JW Marriott Hotel in downtown Miami.

Trueba’s practice centers on the domestic and international enforcement of intellectual property rights. He is a patent attorney registered with the United States Patent and Trademark Office. In addition to litigation, he is also experienced in the prosecution of patent and trademark applications. Trueba received his Juris Doctor from the University of Miami School of Law and his Bachelor’s of Science in Electrical Engineering from Florida International University.
