California Senate Bill Becomes Effective for Children Safety by Using Toy Guns

California Senate Bill No. 199 Chapter 915 (1), which addresses a device that expels a BB or pellet that exceeds 6 millimeters in caliber within the definition of a BB device, has been approved by the Governor on 30 September 2014.

SHENZHEN, China - Nov. 27, 2014 - PRLog -- Senate Bill No. 199 was introduced to make BB devices that expel a projectile such as a BB or a pellet that is 6 or 8 millimeters in caliber, subject to prohibition, unless such devices meet specific coloration requirements.  Spot marker guns that expel a projectile larger than 10 millimeters in caliber, are excluded from the prohibition.

Toy Labeling to Improve Children Safety

U.S. federal law on toy gun marking, 15 CFR 1150, requires a toy gun to be marked according to any one of the following:

(a)    A blaze orange (Federal Standard 595a, February, 1987, color number 12199, issued by the General Services Administration) or orange color brighter than that specified by the federal standard color number, solid plug permanently affixed to the muzzle end of the barrel as an integral part of the entire device and recessed no more than 6 millimeters from the muzzle end of the barrel.

(b)    A blaze orange (Federal Standard 595a, February, 1987, color number 12199, issued by the General Services Administration) or orange color brighter than that specified by the Federal Standard color number, marking permanently affixed to the exterior surface of the barrel, covering the circumference of the barrel from the muzzle end for a depth of at least 6 millimeters.

(c)    Construction of the device entirely of transparent or translucent materials which permits unmistakable observation of the device’s complete contents.

(d)    Coloration of the entire exterior surface of the device in white, bright red, bright orange, bright yellow, bright green, bright blue, bright pink, or bright purple, either singly or as the predominant color in combination with other colors in any pattern.

California Senate Bill 199 mandates that if option (a) or (b) of the U.S. federal regulations described above is chosen, the toy gun shall meet the additional requirements described below:

(A)    If the airsoft gun is configured as a handgun, in addition to the blaze orange ring on the barrel required by federal law, the airsoft gun trigger guard must have fluorescent coloration over the entire guard, and a two centimeter wide adhesive band around the circumference of the protruding pistol grip that has fluorescent coloration.

(B)    If the airsoft gun is configured as a rifle or long gun, in addition to the blaze orange ring on the barrel required by federal law, the airsoft gun trigger guard must have fluorescent coloration over the entire guard, and a two centimeter wide adhesive band with fluorescent coloring around the circumference of any two of the following:

(i)    The protruding pistol grip.

(ii)    The buttstock.

(iii)    A protruding ammunition magazine or clip.
