NEW YORK - Oct. 17, 2014 - PRLog -- In the matter of Mark H. v The City of New York, et. al., Mark alleged that he was a victim of the NYPD after he was arrested where he lives and charged with violating NY PL 140.05, criminal trespass.

According to the allegations within the Complaint, Mark lives at home with his mother in Brooklyn, NY at a property known as The Sumner Houses, which are NYCHA residences. On March 4, 2014, and at about 7PM, Mark's mother was complaining of noise coming from above and so Mark went to investigate. Mark's investigation took him to the rooftop of the building where he encountered multiple NYPD agents. The officers demanded Mark's ID and Mark produced a valid NY State Driver's license which indicated that he lived in an apartment there. The officers then frisked Mark and although he had no weapons or contraband on his person, he was arrested and charged with three counts of criminal trespass; violating NY PL 140.05, 140.10 and 140.15.

At arraignment, the case was adjourned in contemplation of dismissal and he subsequently filed a lawsuit. Michael Redenburg represented Mark and regularly represents citizens who are victimized by the very people charged with protecting them - the NYPD.
