Jeffrey Jacobs, associate general counsel for DTI, and Tony Merlino, director of forensics at DTI, will co-host an informative session addressing the challenges that discovering data in the cloud presents and making recommendations on how organizations can implement processes to confidently deal with cloud data in the legal discovery process. Preservation, collection, review and production of text messages, enterprise cloud applications and social media are among the topics to be addressed in the webinar.

“Under the Federal Rules of Civil Procedure, a party to litigation is expected to preserve and be able to produce ESI that is in its possession, custody or control,” said Jacobs. “When data is in cloud-hosted applications, there are unique challenges. What data does your organization keep in the cloud, and who controls it? Can it be put on litigation hold? How can it best be retrieved for eDiscovery review and production? What special techniques are required to collect data from the cloud and from social media sites? This webinar will address these questions to help legal professionals understand the issues and implement sound processes for complying with eDiscovery rules.”

About the Speakers

Jeffrey Jacobs – Associate General Counsel and Senior Consultant


Jeff Jacobs is the associate general counsel for DTI and also a senior consultant in the company’s national eDiscovery consulting practice, where he assists corporate and law firm clients with eDiscovery process design, validation and execution, litigation readiness and records and email management and retention issues. He has more than 20 years’ experience as an in-house and outside litigation counsel, much of it spent executing or managing complex eDiscovery matters. Jacobs has published numerous articles and spoken before many groups on eDiscovery, litigation readiness and records management issues and has also served as a Rule 30(b)(6) witness on such issues. He is a graduate of Williams College and the University of Chicago Law School.

Anthony Merlino – Managing Director of Forensics, East and National

Tony Merlino is responsible for leading DTI’s forensics/data collection business.  Merlino has more than 20 years of diverse litigation and process improvement experience as a consultant and provider of litigation support services to corporate legal departments and class action plaintiffs firms. He  specializes in developing and implementing protocols for the preservation, acquisition, search and production of email and electronic data in litigation, M&A and government investigations. He has successfully prepared, presented, negotiated or defended protocols for the exchange of electronic data in civil litigations and in proceedings before several government agencies, and he has developed computer forensics evidence and testified successfully as an expert in fraud and trade practices litigation. Merlino is a graduate of Temple University.
