CHAPPAQUA, N.Y. - July 7, 2014 - PRLog -- In the New Castle Justice court this month, a 52 year old man was prosecuted for criminal mischief in the 4th degree, a class "A" misdemeanor punishable by up to one (1) year in jail stemming from a domestic incident with his live-in girlfriend.  The man, whose identity was made known in Court but will be redacted for the purposes of this article was able to have all charges against him dismissed and the file fully sealed one week after Westchester criminal lawyer Robert Schuster presented an arsenal of arguments at arraignment.

Mr. Schuster's arguments involved an illustration of the inapplicability of the Criminal Mischief statute to the damage of property owned by the defendant, along with a presentment of case law and proof in the form of a deed to his client's home.  Mr. Schuster also cited the great injustice that an order of protection was issued, barring the defendant from his home because it was the temporary residence of his paramour, the complaining witness.  After the Westchester District Attorney's Office withdrew the charges in the interest of justice, that order was vacated days and Mr. Schuster's client was permitted to return to his home and institute eviction proceedings.
