Federal Court Lawsuit Alleges Sexual Assault by Massage Therapist in Spa of Luxury Cruiseship

Fort Lauderdale, FL - Farmer, Jaffe, Weissing, Edwards, Fistos & Lehrman attorney Adam Horowitz announces the filing of a lawsuit in federal court in the Southern District of Florida against MSC CRUISES for the alleged sexual assault of passenger by a massage therapist in the spa of a luxury cruise ship, MSC DIVINA.

According to the Complaint:

* The victim, ADRIAN MACIAS, is an adult male who resides in Las Vegas, Nevada. Adrian boarded an MSC CRUISES ship, MSC DIVINA, in Miami, Florida as a paying passenger on May 3, 2014, for a seven-night cruise.

* Adrian booked three massages for himself during a vacation on MSC DIVINA. During two of the massages, he was assigned to the same male massage therapist. During the first massage, the massage therapist’s genitals grazed against Adrian’s hand and he massaged Adrian close to his genitals. Adrian was stunned, embarrassed and confused as to what occurred.

* Adrian was assigned a different massage therapist for his second massage and there were no incidents of misconduct. During the third massage, Adrian was again assigned to the offending massage therapist, who was more brazen this time and put his finger around Adrian’s penis and fondled Adrian underneath his genitals and near his anus. This time Adrian was frozen in fear as a result of what transpired.

* Adrian reported these assaults to MSC CRUISES before he disembarked MSC DIVINA in Miami. He also reported the assault to the Federal Bureau of Investigations. Adrian recalls the massage therapist stated that he was from Bali, but he does not know the name of the massage therapist and MSC CRUISES has not yet disclosed his identity to Adrian.

The lawsuit alleges that trust was horrifically betrayed when a massage therapist seized the opportunity to sexually assault him on a massage table. Under Federal law, MSC CRUISES is responsible for the sexual misconduct of its crew members while aboard the ship.”
