By: Shapiro Goldman Babboni & Walsh The challenge filed by teachers unions argued that attributing a teachers pay to student performance was unconstitutional based on the Florida State Constitution. The judge in this case, Judge Mark Walker upheld the law noting that while he believed the practice is unfair and problematic, it did not meet the requirements of being declared unconstitutional. Attorney M. David Shapiro of the Sarasota FL Law Firm Shapiro Goldman Babboni & Walsh in Sarasota Florida had this to say about the ruling. “A recent decision where a Federal Judge determined that a Florida law that based teacher pay on how students performed on standardized test although ”unfair,” it was not unconstitutional. The standard isn’t fairness, but rather “ if the policy is rational.” This decision emphasizes the importance of electing good legislators because the Courts can only help within the framework of our laws, and not save us from bad legislation.” About Attorney M.
