Over a Hundred Authorization Documents will be Abolished by the Implementation of Bill 2436a

May 5, 2014 - PRLog -- Now the outlook for fair business practices and safeguarding the environment in the Ukraine are jeopardized.

Bill 2436a will abolish the number of permits that would allow businesses to do work in the Ukraine.   Many work permits will now be cancelled that will affect the agricultural and energy sectors in the Ukraine.  Permits for new construction work and work related to the extraction of ground water and the laying of cables and pipes will also halt.  The purpose designated for land forest areas will also change, which could have serious environmental impacts.  This bill also aims to halt agreements being made that could impact whether environmental considerations are made for future building projects.  The Committee on Environmental Policy and the Use of Natural Resources and the Chornobyl Aftermath Mitigation both do not support bill 2436a.  The bill is not only aimed at cancelling a great number of licensing documents but also will amend 37 legislative acts of the Ukraine, more than half of which pertain to environmental protection.   The bill will also permit the following:

1.      Cancelling of permits for the completion and design of construction work for the extraction of groundwater.

2.      Cancel road maintenance and projects to improve the safety and quality of roads and transportation.

3.      Cancel permits that prevent placing buildings and other objects in areas that adversely affect the condition and reproduction of forests.

4.      Cancel funds going toward forest management and using forest lands for obtaining minerals, laying cable lines, pipelines, and other utilities.

5.      Cancel environmental impact assessment of construction projects.

6.      Cancel permits for the authorization of the production, storage, transport, use, disposal, and destruction of toxic substances.

7.      Cancel permits for storage and disposal of waste.

8.      Cancel permits for alternative energy research.

9.      Cancel restrictions on GMO (Genetically modified) products.

10.   Restrictions on unregistered pesticides and agrochemicals would likely go away.

11.   Cancel permits for the certification, storage, and processing of grain as well as the movement of grain within the Ukraine.

A large number of these cancelled permits will adversely affect the agricultural sector.  It will also replace a previous bill that required that the licensing authority that gives out the permits do so without the involvement of a business entity.  The FLEX lawyer Eugene Filoneko believes that that the implementation of bill 2436a and the cancellations of these permits will most likely result in a real risk to regional and national food security in the Ukraine.  There is also a real concern that these cancellations could affect business regulations that make businesses adhere to environmental and safety standards, as standing legal requirements that require entrepreneurs to obtain permits to do business could no longer be upheld.  The whole economy of the Ukraine could be adversely affected if these work permits are cancelled.
