Imbesi Christensen client wins appeal; hearing judge's decision reversed

NEW YORK - April 21, 2014 - PRLog -- Attorneys Brittany Weiner and Jeanne Christensen, of the law firm Imbesi Christensen, successfully appealed a hearing judge's decision that sustained the Department of Labor's determination that the firm's client, a former personal assistant employed by behavioral therapist, voluntarily separated from employment without good cause.

After the initial hearing concluded, the hearing judge rendered a decision favor of the employer.  Imbesi Christensen filed an appeal on behalf of the employee, requesting that the hearing judge’s decision be overturned and that an award in favor of the firm’s client be issued.

The Appeal Board reversed the hearing judge's decision and determined that the judge incorrectly ruled that the firm's client voluntarily separated from her employment without good cause.

The Honorable Leonard D. Polletta (member) issued the written decision on behalf of the Appeal Board.

The published decision is titled, "Appeal Board No. 577150."  The initial hearing was assigned A.L.J. Case No. 013-36054.
