Kalka & Baer LLC Gets Settlement for Deceased Victim’s Family Through Uninsured Motorist Coverage

The fatal car accident occurred on Jan. 20, 2013 when another vehicle crashed into the decedent’s vehicle at the intersection of Flat Shoals Road and the State Route 36 Bypass in Covington, Georgia. The  Georgia State Patrol Investigation Unit reviewed both vehicles’ crash data and came to the conclusion that the other driver failed to stop at the stop sign prior to entering the intersection. Meanwhile, the data showed that the decedent had made a full stop before entering the intersection.

The decedent suffered from serious internal injuries that resulted in cardiopulmonary arrest.  Cardiac pulmonary arrest is what happens when blood circulation stops due to the heart’s failure to contract. The mother of Attorney Kalka’s clients passed away within several hours of reaching the hospital. The victim’s insurance company agreed to a settlement amount that is to remain confidential. In addition to the settlement reached with the decedent’s auto insurance provider, Attorney Kalka’s clients had also previously reached a settlement with the other driver’s insurance company, which had made payment on the policy limits in exchange for a limited liability release. The other driver ended up being indicted in Newtown County on charges of 2^nd degree homicide by vehicle and failure to stop at a stop sign.
