According court documents, Attorney Weyher’s client had her child at the age of 19. The client states that about a year and a half ago, her own mother and grandmother came to her apartment and took the child and all of her things. Attorney Weyher’s client says that the women claimed they were taking the child because the young mom was neglecting and abusing her baby, and that the child was living in an environment that was unsafe.
Court records show that the baby’s great-grandmother ended up winning full custody, even though there was documentation that indicated a lack of evidence behind their claims. The court documents included a police report in which officers who were called to the home said the child seemed fine, and a report from a child welfare case worker who stated that there was insufficient evidence of physical neglect.
Attorney Weyher says that the rules were not properly followed and that his client had her rights violated by the court. In court documents Attorney Weyher asserts that the judge presiding over the case based his decision solely on allegations, and that there was no hearing that allowed the young mother to defend herself.
