Philippines Introduces New Permit for 9(g) Pre-arranged Employment Visa Applicants

The Philippines' Department of Labor and Employment (DOLE) has introduced a new permit applicable only for the foreign nationals applying for 9(g) Pre-arranged Employment Visas

SUNNYVALE, Calif. - March 14, 2014 - PRLog -- The Philippines' Department of Labor and Employment (DOLE) has introduced a new permit applicable only for the foreign nationals applying for 9(g) Pre-arranged Employment Visas, all other visa categories are exempted. Companies are now required to fulfill additional document requirements for 9(g) visa applicants, reports Nair & Co.’s International Business Expansion (http://www.nair-co.com/international-business-services.aspx) Team.

Earlier, applicants applying for the 9(g) visa were allowed to work after completing the Alien Employment Permit (AEP) application. As per the new rule, applicants can start working only after receiving a Provisional Work Permit (PWP), while the AEP application is under process.

PWP has to be obtained by both – applicants who have applied for the 9(g) visa with pending AEPs and applicants with 9(g) visa and working in Philippines. It is important to note that the Bureau of Immigration’s Manila office is currently responsible for accepting and processing the PWP applications.

After submitting the AEP application to DOLE, employers must apply for the PWP. Copies of the documents that must be submitted include:

§         An AEP card – for applicants applying for the first time, the DOLE receipt for the AEP application.

§         Proof denoting that a Philippine Taxpayer Identification Number has been secured.

§         A letter from the employer to the Bureau stating that Philippine taxes on the applicant’s income will be duly withheld and submitted.

PWP has a validity of three months and shall expire once the 9 (g) Employment visa is issued to the applicant. However, additional information about the requirements related to PWP is likely to be issued by the Bureau in the next few weeks.

Nair & Co.’s International Expansion Team advises companies to give more time and plan well in advance of requesting 9(g) employment visas, as employees can start work only after obtaining the PWP.
