Companies Can Take Steps to Protect Themselves from Lawsuits

Companies can take steps to protect themselves from lawsuits, says Frank Hursh, owner of Texas Energy Insurance

Jan. 18, 2014 - PRLog -- Statistically speaking, companies with 100 employees will be faced with an employment practices related lawsuit once every three years. The prevalence of these lawsuits points to an increasingly important need for companies with employees to take steps to protect themselves from lawsuits.

“While there is no way to guarantee immunity from potential lawsuits, there are some steps that you can take to help reduce your legal liabilities –lowering the chances of a lawsuit,” says Hursh.

According to Hursh, taking measures to combat discrimination in the workplace can help to reduce the chance of a lawsuit. Since discrimination lawsuits account for a huge proportion of workplace related lawsuits, employers should focus on antidiscrimination policies, and creating a safe work environment.

“According to some estimates, the number of discrimination lawsuits has increased by more than 2000% in the last twenty years!” says Hursh.

“Having antidiscrimination policies in place, educating employees on discrimination in the workplace, and being proactive in disciplinary measures towards employees who engage in discriminatory behavior can go a long way towards creating a safe work environment, reducing the chances of a discrimination lawsuit,” says Hursh. “If a lawsuit is brought against you, being able to prove your company’s antidiscrimination policy and efforts can help tremendously should you need to prove your case in court.”

Hursh says that having workers compensation for employees is another step towards lawsuit prevention. Since an average of two hundred workers are hospitalized every day due to work-related injuries, workers comp can help to ensure that injured workers are given the compensation that they need, without forcing them to seek compensation through legal action against the company.

“The risk of a workplace related accident is high –even for what are considered low-risk occupations,” says Hursh. “With a workers’ compensation insurance policy, you can help to protect your company from a lawsuit. In Texas, the law offers valuable protection to companies that have workers’ compensation for their employees,”

According to Texas worker’s compensation law, if an injured employee recovers workers’ compensation, they cannot sue their employer for additional compensation –except for extenuating circumstances. This protection helps companies to reduce the chances of a workplace injury liability lawsuit.

In some cases lawsuits cannot be prevented –even for the most diligent company. Hursh says that companies should protect themselves in case of a lawsuit, with Employment Practices Liability Insurance (EPLI). EPLI provides valuable coverage to employers against workplace related lawsuits, including discrimination lawsuits.
