DELRAY BEACH, Fla. - Dec. 13, 2013 - PRLog -- “This is an extreme case of negligence on the part of the staff at Grand Villa of Delray East, the assisted living facility whose care Mr. Pinggera and his loving family placed their trust in,” says nursing home abuse and neglect personal injury lawyer Craig Goldenfarb. “Mrs. Pinggera and her family should retain a lawyer immediately to bring suit against the owners of this facility for their gross breach of conduct and care against this family.”

Mr. Pinggera suffered from dementia when he moved into Grand Villa of Delray East at 14555 Sims Road in Delray Beach. The staff should have known that patients with special needs like Mr. Pinggera should be kept under the watchful and well-trained eye of staff, and there is no reason he should have been able to simply wander around the property at night unsupervised, or at least without the awareness of nursing staff.

Sadly, his body was discovered shortly after he was first reported missing. He had not made it off the property, and Palm Beach County Sherriff’s officers determined his death was attributable to accidental drowning.

The property on which this potential nursing home abuse case occured is owned by a man named Robert G. Schemel, who likely has business partners involved in the assisted living care facility. Another facility, called Colonial Inn Assisted Living Home, lists the same address as that of Grand Villa.

Mr. Schemel has been a named defendant in several Palm Beach County lawsuits against his various retirement and assisted living facilities since at least as far back as 1989, according to county civil court records.

“The estate of Mr. Pinggera, which includes Mrs. Evelyn Pinggera, has what in my opinion is a potentially very strong negligence claim against Grand Villa, its owners, its staff, or all three parties,” said Mr. Goldenfarb.
