NEW YORK - Dec. 12, 2013 - PRLog -- Attorney Kevin Johnson successfully represented an employee that was initially denied benefits by the Department of Labor.   The firm’s client was employed by The Mount Sinai Hospital.  The Department of Labor claimed that the firm’s client was terminated due to misconduct and not entitled to unemployment insurance benefits.

The Honorable Lisa Badner issued an award, in favor of the firm's client, after a hearing was conducted.  The decision overruled the initial determination by the Department of Labor that the employee was terminated for misconduct and not entitled to unemployment insurance benefits.

Specifically, the decision set forth the following:

DECISION: The initial determinations disqualifying the claimant from receiving benefits…on the basis that the claimant lost employment through misconduct in connection with that employment …is overruled.
