Imbesi Christensen client wins hearing against NYC Transit Authority after successful appeal

NEW YORK - Nov. 18, 2013 - PRLog -- Attorney Brittany Weiner successfully represented a former employee of the New York City Transit Authority ("Transit Authority") that was terminated for allegedly ingesting cocaine, based upon the results of a drug test.  After an initial hearing, the Honorable Michelle Burrowes determined that the firm’s client was properly terminated for violating the employer’s drug policy.

Subsequent to the decision, Imbesi Christensen filed an appeal on behalf of the employee, requesting the initial decision be overruled.  The Honorable Geraldine A. Reilly, on behalf of the Appeal Board, overruled Judge Burrowes’ decision and granted the former employee's application to reopen the case.

At the hearing mandated by the Appeal Board, Imbesi Christensen was able to prove that the medical testing company made several errors in conducting and recording the claimant’s drug test.  As a result, Judge Burrowes issued an award in favor of the claimant.

Specifically, the decision set forth that the “initial determination, disqualifying the claimant from receiving benefits…on the basis that the claimant lost employment through misconduct in connection with that employment …is overruled.”
