DWI Refusal Lawyer Receives Notice That Client's Case Closed

NEW YORK - Nov. 4, 2013 - PRLog -- The firm's client, Charles, appeared with Attorney Michael J. Redenburg, Esq., on October 11, 2013, at 19 Rector Street before the Honorable Robert Krengel, facing allegations that he refused to submit to a Chemical Test. Charles had been charged with a NY DWI and it was also alleged that he refused to submit to a chemical test at the arresting officer's request. If a NY licensee refuses an officer's requests to submit to a chemical test, and the NY motorist was given sufficient warning, in clear and unequivocal language, of the effect of such refusal, and the motorist persists in such refusal, the individual's license may be revoked for one year.

At Charles' Refusal Hearing, DWI Lawyer Michael J. Redenburg, questioned Charles before ALJ Krengel about the circumstances surrounding his alleged refusal to take the chemical test. After hearing testimony in this regard, the Hearing Judge closed the case, determining that "the evidence failed to establish that respondent was given warnings in clear and unequivocal language."
