Attorney Jeremiah Denslow Helps Juvenile Defendant Get Felony Charges Reduced to Misdemeanors

DAYTON, Ohio - Oct. 18, 2013 - PRLog -- A 15-year-old boy who was initially charged with abduction and gross sexual imposition in Montgomery County, Ohio was able to get his charges reduced, according to the delinquency magistrate’s order of adjudication and continuance in his case. Because the charges were reduced from felonies to misdemeanors, the teenager was able to avoid some of the more serious penalties he was initially at risk of receiving. According to the juvenile court document, the court ruled in August 2013 that the boy was a juvenile delinquent, and it amended the abduction charge to unlawful restraint (a third-degree misdemeanor) and the gross sexual imposition charge to public indecency (a fourth-degree misdemeanor). The court issued the adjudication under the reduced charges after the boy provided a voluntary admission. The offense is alleged to have occurred in June 2013.

According to Attorney Denslow, who represented the defendant, the boy was accused of committing the offenses against a teenage girl outside a local shopping mall. The lawyer noted that under the previous charges, the juvenile could have been sentenced to confinement by the Ohio Department of Youth Services (DYS) until his 21st birthday. DYS is described on its website (www.dys.ohio.gov/dnn) as the state’s juvenile corrections system that confines felony offenders who are between the ages of 10 and 21. The teen would have also been required to register as a sex offender, even after he turned 18. Because of the charge reductions, however, the juvenile defendant was instead adjudicated for misdemeanor crimes that were not sexual in nature, which allowed him to avoid incarceration and sex offender registration requirements. He was instead facing probation that would likely only last for about six months. Both the juvenile and his family were happy with the outcome of the case.
