Teh case began when the client was stopped at a DWI checkpoint and asked to take a breath test. The portable breath test machines are routinely broken and not working. The client refused a breath test when the police officers would not let him contact his attorney as is required by law. The police officer had taken away the client's cell phone and the telephone in the precinct would not call an outside number.
