Chinese Drywall - Re-Construction, Insurance, and Warranties ?? Confirm Policy Scope and Coverages !

Abatement, Treatment, Testing, and Re-Construction of Tainted Corrosive Chinese drywall structures has become very competitive, with numerous unscrupulous Contractors who fail honestly and professionally to not only answer the average Consumers' questions truthfully, factually, and thoroughly, but also fail to disclose details of their warranty or guarantee, which after close review, really does not exist as based on their specific coverage or actual liability insurance policy coverage.

Foreman and Associates has asked this question everytime someone starts talking about their knowledge level, expertise, educational background, or who and why our clients should trust what they recommend, promote, sell, or endorse.

Victims of this major construction crisis that occurred had no warning of the magnitude, cost, health issues, and risk associated with the purchase of their DREAM HOME, which became a NIGHT-MARE or FINANCIAL DISASTER for those who were affected or infected with Tainted Corrosive Chinese Drywall (TCDW).

Consumers have been summarily thrown to the wolves and left to fend for themselves, with little or no specifics. NO CERTIFIED or GURANTEED abatement, treatment, or testing guidance issued by the EPA, CPSC, Federal and State Health Departments, Builders, Developers, Installers, Manufacturers, Suppliers, Lenders, and others. After detailed reviews of all current guidelines, most consumers, if not all, discover that basically the property owner has no definitive or standardized guidelines to follow, except those provided by whomever is performing the work, or quite simply, ... the contractor's opinion of what needs to be accomplished.

Following Foreman and Associates' standard abatement, site testing, re-construction, and final clearance testing protocol will result with the option to purchase a property-specific insurance policy, with no hidden polution exclusion, and that is fully transferable, protecting not only the current homeowner, but also providing future guarantees and warranties in the event a future sale of the structure occurs. Victimized Consumers who turned to the US Court System for justice are rapidly finding out that the Judgments issued by the Courts are worthless or hollow victories until perfected or collected. Treatment and Testing for Chinese or Tainted Corrosive Drywall sounds simple and easy until Consumers or victims start asking specific questions, requesting and requiring details concerning so-called warranties or guarantees ...

All the Government agencies have thus far provided are "interim guidelines" or "life safety guidelines" concerning  the ABATEMENT, TREATMENT, TESTING AND POST TREATMENT TESTING PROCESS.

Guidelines that on the surface, sound or look complete, but actually raise more questions than answers when reviewed, initiated, and are scrutinized closely by trained professionals.

Abatement sounds good, but who will Insure, Guarantee, and Certify ???

Insurance Professionals and Policy Experts have reviewed numerous documents and find most DO NOT provide actual coverage for a claim related to or caused from Tainted Corrosive Drywall or a faulty abatement; not to mention, those documents lack specific details required to file or collect on a claim !!!

Let's look at the first issue - ABATEMENT.

What needs to be abated ???
Who determines abatement protocol ???
How do you perform the abatement ???
Who is qualified to perform the abatement ???
Who is qualified to determine the level of abatement ???
How do you confirm the abatement was successful ???
Who guarantees or insures abatement after completion or clearance testing ???
What licenses are required for the abatement, treatment, and certified clearance tests ???
Who pays for the abatement ???
Who pays for a failing abatement re-test ???
How is a failing abatement defined and by whom  ???

Those are many of the simple and legitimate Consumer Questions ...

I would hope that by this juncture you are starting to understand the problems and questions I'm discussing that Consumers need answers or specific guidance on prior to starting or signing a corrective abatement, treatment process, and contract or, for that matter, paying for anything.

Consumers need to do their homework to understand that ONE SIZE DOES NOT FIT ALL - corrective repairs, corrective protocols, and numerous other abatement and treatment options will not be COST EFFECTIVE in solving your specific Tainted Corrosive Drywall issues. In numerous cases, some protocols or abatement guidelines FAIL to solve the issues for the long-term, and these future failures are not covered by the Policy or Warranty as was issued by the contractor who performed the corrective work.

Before making an abatement or treatment decision, please have a licensed Insurance Professional and/or an Attorney review the Policy or Warranty that claims to cover your abatement and treatment.
