Mesriani Law Group Obtains $39.5K Settlement for Sexual Harassment Victim

 
LOS ANGELES - July 29, 2013 - PRLog -- The topnotch Los Angeles employment lawyers of the Mesriani Law Group (MLG) have recently secured a $39,500.00 settlement for a female employee who was sexually harassed and retaliated against by her former superiors after complaints of their wrongful conduct.



Case files revealed that the client-employee is a 52-year-old Hispanic woman who worked as an accounting coordinator for an undisclosed California company for seven years, from 2005 to 2012. Throughout 2011 and 2012, she was sexually harassed by her superior, the Chief Executive Officer (CEO) of the company, and was subjected to retaliation by the company’s President/Chief Operating Officer (COO).



It started on February 4, 2011 when the CEO talked to her about his wife who underwent a hysterectomy and how it affected their sex life. He also told client-employee about his “mistress hunting,” but realized it would be too costly for him. He then told her that although that is the case, he would be willing to pay a hundred dollars for oral sex.



The next day, the conversation between the two broadened; the CEO started talking about his home in Sierra Madre, and how he would be alone for that day because his wife was going to their new condo unit in Temecula. He then invited client-employee to stop by if she was ever in the area. Later that afternoon, the CEO asked her to “swing by his house after work to have a drink.” He provided her a map showing the direction to his house. In fear of being judged as unsympathetic, she accepted the invitation.



Client-employee arrived at the CEO’s house at 4:45 p.m., where she was welcomed by the latter with drinks in his hands. She thought the drink was too strong as she was driving and wanted to remain safe on a Friday night, so he poured out a new, weaker drink. The CEO later offered her to take a grand tour of his home.



Later on, the CEO informed client-employee that he was concerned about her job security if the COO learns about their meeting outside the work schedule. She became extremely anxious of it, more so after she was warned that she might be terminated simply for agreeing to meet with him. She was startled and began to fear that her job is in jeopardy after she was told how the CEO had witnessed the COO berate his employees and business associates for saying something he did not want to hear.



She became uncomfortable after the CEO talked anew about his need to find a mistress to satisfy his needs. He knew that her finances were in arrears and that she desperately needed her job. Her fear was realized when she was told that he would pay her a hundred dollars in exchange for oral sex. She left the place feeling anxious and violated.



As client-employee reported back to work on Monday, the CEO told her to “forget about what happened Friday night,” although he told her how he enjoyed what happened yet felt guilty at the same time. Out of fear of being retaliated against, she agreed to keep the incident between them to herself. She continued to work satisfactorily, while the CEO continued to make sexually charged comments towards her.



The client-employee’s stress and fears of losing her job worsened after the President/COO of the company scolded her for putting a call for him from a bank on hold. Under much stress, she decided to go home, where she experienced a panic attack. She decided not to report to work the following morning because of it.



On April 2012, the client-employee advised the accounting manager that she would not be able to handle the COO’s belligerent attitude towards her and the CEO’s sexual comments anymore. However, the accounting manager ignored her pleas and just shrugged her shoulders.



That same month, the COO summoned client-employee to discuss her “attitude,” and that she was being suspended for two and a half days without pay. Any further “poor attitude” would result in termination, the COO advised her. She then went to see her doctor and was placed on short term disability for six weeks for anxiety and/or depression.



Her condition worsening, she was placed on extended disability leave until July 1 of that year. However, despite the company being told of her disability, it decided to offer her a severance package of only $4,866.40. Her treating physician later extended her leave to July 18, but the company threatened her that it was unlikely to have her extension granted beyond the said date. Because her conditions were not improving, her physician again extended her leave to August 29. Instead of accommodating her medical condition, the company decided to terminate her July 18.



Her ordeal during the course of her employment evidently caused her to experience emotional and financial setbacks. She was clearly a victim of employment discrimination and harassment on the basis of sex. To make matters worse, she was likewise retaliated against after advancing her complaints by terminating her unlawfully.
