Revisions In Late August For Florida Realtor’s Most-Used Contracts

FORT LAUDERDALE, Fla. - July 24, 2013 - PRLog -- Kevin Tacher, Founder and CEO of Independence Title, Inc. brings a greater understanding to the changes in store for the Florida Realtors/Florida Bar Residential Contract, the AS IS companion and the Comprehensive Rider.  Change over to the new forms will happen sometime in late August.  “To my knowledge Florida Realtors will send a notice out with a specific date as the release day approaches.” said Tacher.  “Just as a head’s up, Realtors should know they’ll pull the current forms offline by Labor Day.”

Also known as Florida’s “Title King,” Tacher honed in on the contract recommended jointly by the Florida Realtors and the Florida Bar for the sale and purchase of real estate in Florida.  “I discuss the FloridaRealtors/FloridaBar Contract because it tends to be more neutral or equally fair to both parties.” added Tacher. “It comes highly recommended because the Florida Bar Association employs a standing committee that solely reviews the form and recommends changes that will be consistent with case law and statute updates.  It’s really best to take that advantage.”

Tacher further discussed the AS IS contract, or what’s commonly known as an addenda.  The companion contract typically does away with the seller's obligation to make repairs for items not in working condition on the property for sale.  It also removes the seller’s obligation for damage caused by wood destroying organisms.  In return, the terms and conditions usually require the buyer to perform whatever due diligence they deem necessary to fully understand the condition of the property and thereby commit to buying it.  This due diligence would include any inspections to the property they so desire.  

“It’s important to note that in Florida the AS IS contract, or addenda, doesn't remove any legal obligation to disclose conditions that may be contrary to the potential sale of the property.  Revisions or no revisions to the commonly used contracts it will always be incumbent upon the seller to do the right thing.” said Tacher.
