Hearing Judge issues award in favor of Imbesi Christensen client charged with misrepresentation

NEW YORK - July 15, 2013 - PRLog -- Attorneys Brittany Weiner and Jeanne Christensen successfully represented a former employee of National Wholesale Liquidators of Lodi Inc. (National Wholesale Liquidators).  The employer claimed that the employee was not terminated, but rather "voluntarily separated" from his employment.   After being terminated, National Wholesale Liquidators attempted to have the client's unemployment benefits denied and receive reimbusrement for benefits paid, based upon an alleged misrepresensation by the former employee.  

The Honorable Craig Fishkin issued an award, in favor of the firm's client, after an in-person hearing was conducted.  The decision overruled a determination by the Department of Labor that the employee was not entitled to unemployment insurance benefits and must repay all money received.  

Specifically, the decision set forth the following:

DECISION: The initial determinations charging the claimant with an overpayment...recoverable pursuant to Labor Law Section 597 (4)...on the basis the claimant made a willful misrepresentation to obtain benefits, are overruled.

The claimant is allowed benefits with respect to the issues decided herein
