MARIETTA, Ga. - July 11, 2013 - PRLog -- With the help of Henrickson & Sereebutra, LLC, a young man was acquitted of his forgery and theft charges, allowing him to avoid years of imprisonment and an expensive fine. The firm’s Marietta criminal defense attorneys represented the 19-year-old during his trial and were able to convince the jury that the defendant lawfully received the check that was reported stolen and that he attempted to cash what he believed to be a good check. Henrickson & Sereebutra, LLC provides protect their rights after they are accused of crimes.

The defendant, who had no criminal record, was specifically charged with first-degree forgery and theft by taking, and he was facing up to six years of imprisonment and a fine of up to $101,000. In the trial, the State presented evidence indicating that the victim’s house had been burglarized and inferring that the defendant and/or his acquaintances were involved in the crime. The State then presented evidence that the defendant presented a $2,500 check to Bank of America, and that he was detained by bank officials while law enforcement was called.

In response to the allegations, the legal team at Henrickson & Sereebutra, LLC presented a case showing that the defendant was provided the check in question by his employers, who asked him to cash it so that they could purchase supplies for a construction job. The lawyers also argued that when the defendant went into the bank and encountered difficulty in cashing the check, his employers left him at there to be later arrested by the police.

The evidence in the case clearly established that the defendant presented and tried to cash a check that was reported stolen by the victim. The victim testified that no authority had been given to the defendant to take such an action. In the end, the firm was able to persuade the jury that circumstantial evidence proved that the defendant mistakenly believed he was authorized to cash the check, and therefore, the requisite intent to defraud had not been proven.

Despite the serious allegations the young man was facing in a case that appeared to be without a defense, Henrickson & Sereebutra, LLC was able to effectively present the defendant’s side of the story. Following his not guilty verdict, the defendant walked out of the courtroom a shaken but free man.
