A woman from South East England has been awarded £12,500 in dental compensation, after seeking legal advice from the Dental Law Partnership when a wisdom tooth extraction at a nearby hospital resulted in permanent nerve damage.

The client, a 42 year old, was referred to the hospital by her dentist in April 2010, after making complaints about the pain in her wisdom tooth on the lower right side,  the dentist only intended for that single tooth to be removed.

In spite of this, when the woman attended a consultation at the hospital in June 2010 a surgeon advised that she have all four of her wisdom teeth extracted and not simply the tooth which had been causing the pain. Incredibly, while no clinical notes were taken at the appointment, an X-Ray shows that the root of the lower left wisdom tooth was located extremely close to a nerve; posing a very high risk of damage if this healthy tooth was taken out.

In October 2010, all four wisdom teeth were removed by another consultant. While the client did sign a consent form for the extraction to take place, this document did not contain any specific warning of the risk of damage to the nerve, due to its proximity to the tooth.

Less than 2 weeks after the procedure, the patient returned to her regular dentist to complain about the severe pain she was experiencing at the site of the damaged nerve. Almost a year later, she was still experiencing numbness in her lower left lip, due to the permanent nerve damage she had suffered (http://www.dentallaw.co.uk/client-stories-details.php?id=43) as a result of the extraction of a healthy tooth.

The hospital trust admitted liability for  the problem, and the Dental Law Partnership helped their client to claim £12,500 in an out of court settlement.

Speaking after the decision, the client said: “You naturally trust the judgement of dental surgeons, if I’d have know what would happen I wouldn’t have had the bottom left wisdom tooth extracted.  At least I now have the damages to compensate me for the pain I have suffered.”
