It is no wonder why, when one is being issued every 4 seconds, which works out to be 8 million tickets per year. Councils are said to be making it harder than ever to steer clear of tickets. PHD Legal Advice take a look at how you can avoid Penalty Charge Notices.

Every 4 seconds, someone in England and Wales is issued with a penalty charge notice, which is 8 million of us every year. It seems that if you are careful, if you read all sign posts, and follow the law on the road, you will not get a PCN, however it is being said that councils are making it extremely difficult to avoid these penalty charge notices, and with under 1% of the penalty charge notices actually being appealed, councils are making millions of pound from these tickets. “If the average parking ticket is £70, and less than 1% of the 8 million being issued with them are appealing, that makes over 550 million pounds per year for the councils issuing these tickets, and that doesn’t include the added fine if you pay don’t pay for the ticket on time!” says Casper Sibanda, Managing Director of PHD Legal Advice.

The numbers are staggering. But why aren’t the public appealing tickets if they know that they were wrongly fined? “The main worry is fear that they will not win, if you fail to win your appeal, your ticket fine can almost double, anywhere from £110 and upwards, many are just worried they will not win, and along with the added hassle of appealing, it could cost so much more and for most it is just not worth the hassle” says Tamim Tasdik, Legal and Financial director of PHD Legal Advice. Around 50% of appeals made actually turn out successful for the driver fighting the ticket, due to poor signs or roads. “If just 10% of those issued with a PCN actually appealed, drivers could be saving themselves up to 56 million pounds a year in England and Wales alone, this really is a serious matter that drivers should be taking seriously, without the fear of losing an appeal” says Casper Sibanda, Managing Director of PHD Legal Advice.

With examples of poorly highlighted signs, misleading street lines, and contradicting signs, millions of PCN’s have been issued in the past, when councils have been made aware of these mistakes, the issue of PCN’s had been suspended, however those issued tickets previously due to an illegal sign, were not given a refund in most cases, even though the signs were illegal at the time the penalty charge notice was issued.

“The best advice is if you think your parking ticket was issued wrongly, do something about it. Don’t just pay the fine because you don’t want to risk paying more. The chances are, if a sign has confused you into getting a ticket, there have probably been others in the same situation, and that sign is potentially illegal” says Tamim Sibanda, Legal and Financial director of PHD Legal Advice.
