Appeal Board upholds hearing Judge's decision in favor of Imbesi Christensen's client

NEW YORK - May 9, 2013 - PRLog -- Imbesi Christensen successfully defended an an appeal of an initial hearing award issued in favor of the firm's client.  

In the initial hearing, attorney Brittany Weiner, an associate of the law firm, successfully represented a former employee of SLEEPY'S LLC (SLEEPY'S) who was initially denied unemployment benefits.  

The Honorable Charlesa London issued an award, in favor of the firm's client, after a hearing was conducted.  The decision overruled the initial determination that the employee was terminated due to misconduct.  Specifically, the decision set forth the following:

DECISION: The revised initial determination, disqualifying the claimant from receiving benefits effective May 22, 2012, on the basis that the claimant lost employment through misconduct in connection with that employment and holding that the wages paid to the claimant by SLEEPY'S LLC prior to May 22, 2012 cannot be used toward the establishment of a claim for benefits, is overruled.  The claimant is allowed benefits with respect to the issues decided herein.

Subsequent to the decision, SLEEPY'S  filed an appeal, requesting the initial decision in favor of the firm's client be overturned.  The Honorable George Friedman, on behalf of the Appeal Board, denied SLEEPY'S appeal and determined that Judge London's decision should be affirmed.  As a result, the law firm's client is allowed to maintain the benefits awarded after the initial hearing.
