What happens to my papers and how do I get them back?

If a solicitor has closed their practice, then they have a duty to manage the closure in an efficient and responsible way. They should, in an ideal world, write to you and let you know how to retrieve your papers.

In the event that this is not the case and you cannot contact your former solicitor, you may need to notify the Solicitors Regulation Authority for them to intervene and take steps to recover your documents. We can assist in this procedure and in the interim, take steps to liaise with you, the Court and all other parties involved in your claim to ensure that your claim is not prejudiced.

What happens to the money that I have paid on account to my former firm?

Again, as with your papers, your former solicitor has a duty to pay out all disbursements, bill for any outstanding costs and account to you for the remainder of any monies held before closing their practice. As this is not always the case, we can again assist in notifying the Solicitors Regulation Authority and instruct them to intervene. The Solicitors Regulation Authority has the power to examine your former firm’s accounts and return any money to you which they are holding.

What will happen to my no win no fee agreement?

If your case is being conducted under a No win No fee agreement, it is likely that that agreement will come to an end on the firm closing down.
