Proposed Central American Technical Regulation (RTCA) on Footwear Labeling

Central American Technical Regulation (RTCA) has been proposed on on Footwear Labeling.
 
May 2, 2013 - PRLog -- The Salvadorian Technical Regulation Agency (Organismo Salvadoreño de Reglamentación Técnica, OSARTEC) notified the World Trade Organization (WTO) in February 2013 of its intention to propose the Central American Technical Regulation (RTCA) No. 61.01.03:12 Footwear and Parts: Labeling Requirements  (1) for the five associated Central American countries – Guatemala, El Salvador, Costa Rica, Nicaragua and Honduras.

The notified Technical Regulation established the labeling requirements for footwear and parts when sold separately that are applicable to the consumer market within the five listed countries. The language on the label should be in Spanish / Castilian. The labeling information should be marked, printed, sewn or glued to the shoe or a label may be hung or attached to the product. The information must be clear, prominent, indelible and legible to the consumer, at the time of purchase and use, and must be present in shoe parts when sold separately and in at least one shoe of each pair.

Exceptions from Technical Regulation  

According to the drafted technical regulation, the following types of footwear are exempt:

- Shoes with toy features;

- Protective footwear (fire resistant) and

- Light disposable or less resistant booties, such as textile, paper or synthetic booties without applied soles.

Note: The labeling of footwear will be used according to the laws of each country.

Required Labeling Information

Required labeling information for footwear or parts according to the drafted technical regulation:

- Country of origin,

- Name and address of the manufacturer or distributor for domestic products,

- Name and address of the importer or distributor for imported products,

- Information about the materials of the shoe parts (parts of footwear must be provided in wording or with pictograms),

- Size of the footwear,

- Other information can be added if necessary to maintain the footwear under optimum conditions of use.

Additional information on labeling requirement:

- If the language of the original label in not Spanish / Castilian, an additional label containing the information in Spanish / Castilian is required.

- The information required may be in one or more labels, whether they are applied by the manufacturer or importer.

- The characters used to present information on the label should not be less than 1mm in height, measured as the distance from the baseline to the upper end of the character.

- The text color must be in contrast with the background and should ensure that the text is clear in normal use.
- The information provided about the material on the label should make up at least 80% of the upper surface and the lining and the insole of the shoe and at least 80% of the volume of the sole. If no materials are over 80%, the label must give the information about the two main materials that make up the shoes.

- The number (or numbers) indicating the size of the shoes must be labeled in each shoe of a pair and must be visible and legible to the consumer.

- When the shoes are in a box or other packaging, the size number must also appear on the packaging.
