Law Offices of Robert M. Geller uses vehicle black box data to win settlement

TAMPA, Fla. - April 8, 2013 - PRLog -- The Law Offices of Robert M. Geller, P.A. is pleased to announce that it has successfully achieved a settlement for a client who was injured in a Tractor Trailer/Automobile accident.    On a clear, bright sunny day, the firm’s client was driving a white SUV north on Interstate 75 near Ocala when it was struck in the rear by a tractor trailer traveling approximately 67 miles per hour.  The impact caused the client’s SUV to spin out of control and flip multiple times before coming to a rest.   Both the client and his passengers were taken by emergency rescue to the hospital after suffering severe injuries.
The challenge the firm faced was that 4 independent witnesses accused the firm’s client of either stopping on the interstate or driving less than 10 miles per hour.  This testimony was supported by the investigating highway patrol officer.  However, expert witnesses provided testimony that, based on computer data collected in the victim’s car, as well as the computer data collected from the Tractor Trailer, that the victim’s vehicle could not have been stopped or going that slowly.   In fact, the data showed our client was traveling no less than 49 miles per hour.   After many hours of settlement negotiations, the insurance company acknowledged fault and fairly and adequately compensated the client for his injuries and damages.
This case demonstrates how important it is to contact an attorney immediately after an accident.  Without preserving the vehicles involved in the accident and the data from the vehicles, our ability to obtain a successful recovery would have been limited.
