For instance, with respect to overtime, both the New York State law and the federal Fair Labor Standards Act (FLSA) require that employers pay overtime to those individuals who are not "exempt" from the overtime requirements. Non-exempt employees covered by the FLSA must receive overtime pay for hours worked in excess of 40 in a workweek of at least 1 ½ their regular rates of pay. Most employees must receive overtime pay at the rate of 1½ times their regular rate of pay for all hours worked over 40 hours in a single work week. In addition, some occupations that are exempt from overtime under the federal FLSA, are still entitled to overtime under the New York State law.
