If the defendant loses, his license will be suspended for one year. That was the case of People v. I.R. The client was accused of having an accident and refusing a breathalyzer test. At the hearing, the administrative judge ruled that the police officer did not provide the required probable case to arrest the client and thus dismissed the case. Mr. Discioarro said " If she lost her license for a year, it would have been devastating.We are very happy we were successful" He went on to say that in New York, those accused of DWI have the right to refuse the breath test and are then charged with refusing at a DMV hearing.
