"For several years, there's been a growing trend among ambulatory surgery centers and their surgeon owners: establishing entities to coordinate the provision of anesthesia and other specialty services to their patients – and to capture the profits," Weiss said.

"This is the so-called 'Company Model' structure. It's often put into place to skirt what can't be accomplished outright: receiving a share of fees in return for referrals. If surgery centers or their owners simply demanded a kickback from the anesthesiologists and other specialists it would clearly be illegal, a violation of the Federal Anti-Kickback Statute as well as of state law."

"More recently, the Company Model has morphed beyond the outpatient setting and is beginning to be seen in several variants in the hospital setting."
