Legal Sentence Against Odesia Group And Odesia Solutions In Mexico

Feb. 1, 2013 - PRLog -- GRUPO VALPI-CARAL and it's legal advisors publicly disclose the legal position of Odesia Group and Odesia Solutions in Mexico after several months and legal procedures initiated due to the non compliance of legal agreements between the parties.

GRUPO VALPI-CARAL notifies to the general public and investors the progress in the labor trial filed by Alfredo Piña Cedillo against Resource IT de México, S.C., Global Business Integration de México, S. de R.L. de C.V., Odesia Group Inc., and Odesia Solutions Inc., where an award or sentence has been ruled condemning these companies to pay to Alfredo Piña Cedillo a non-disclosed six figures ammount in Mexican Pesos; plus accrued wages up to their full payment, and indemnifications according to the legal contracts signed between the parties.  

1.- On June 29, 2010, the work-related complaint was filed against

Resource IT de México, S.C., Global Business Integration de México, S. de R.L. de C.V., Odesia Group Inc., and Odesia Solutions Inc., with the State of Queretaro's Local Conciliation and Arbitration Board.

2.- Out of the mediation talks, we reached the agreement of a payment, by which the conflict would terminate, and thus on October 14, 2010, said agreement was signed, whereby, additionally, it was clearly set that in case of breach, it would become null and the trial would continue. For reasons unknown, the date for the full payment set by the agreement arrived and the company proxies that were going to fulfill the agreement and make the payment never showed up before the Labor Authority, which situation provoked, as aforesaid, the agreement to become null and the trial to continue.

3.- The labor trial continued its legal course and after giving the defendant companies Resource IT de México, S.C., Global Business Integration de México, S. de R.L. de C.V., Odesia Group Inc., and Odesia Solutions Inc., the opportunity to defend the suit and offering and discharging evidence, on past October 11, 2012, the award or sentence was ruled, putting an ending to the procedure, within which the above mentioned sentence has been ruled against the mentioned companies.

4.- It is important to point out that in labor matters, the Mexican laws provide that for as long as the award or sentence has not been paid, there is a concept named "Accrued Salaries", provided for in article 50 section III of the Federal Labor Law and which specifies that for as long as the condemn set by the award or sentence remains unpaid, the equivalent to one day of salary per day elapsed shall be paid; therefore the ruled ammount will keep increasing on a daily basis until the sentence is paid in full.

By virtue of the above, this labor liability should be taken into account within the financial previsions of the companies that have been sued and sentenced through this award.

Our legal advisors have already communicated this sentence to the above mentioned companies, they are respectfully exhorted to voluntarily fulfill the sentence that was imposed on them by a Mexican Labor Court, for otherwise, we will be forced to carry out a payment requirement and consequently, a forced collection at their domicile in the city of Montreal in Canada.
