Ms Finch was sacked from her job after serving her colleague with a generously sized McFlurry after she was requested to “make it a good one”. Her co-worker actually paid the full price for the product, but the extra toppings on the ice cream were seen as misconduct by her employers and she lost her job. Finch maintained that there was no set portion size for McFlurrys so she had not done anything wrong.
She was quoted as saying; “They are always imprecise and will vary among customers”.
Following her dismissal, Ms Finch decided to take legal advice and filed a claim for unfair dismissal against the franchise company Lonetree. They are the company that runs the McDonalds in Camarthen and were therefore responsible for the unfair dismissal of any employees.
Although Lonetree denied any liability, they decided to settle with Ms Finch out of court and paid her compensation of £3,000 and also agreed to give her a good reference courtesy of McDonalds.
