Prosecutors have claimed that Mr. Ebadat sold cars on consignment through his auto dealership, Costa Mesa Bellagio Motors, paid owners, and then transferred the car titles to purchasers while pocketing the money for himself. It has been alleged that buyers could not receive legal car titles due to the holding titles not being paid and that some did not receive the vehicles they had purchased.
While prosecuting attorneys have claimed that Mr. Ebadat emptied his bank accounts and wired the money to overseas holdings, there is much information that has not yet come to light. Attorney Goldman pointed out to news sources that there was much information still to be discussed in the case as he had only recently received “several thousand pages of discovery.”
Mr. Ebadat has been charged with 15 counts of embezzlement by fiduciary of trust, 15 counts of money laundering, and 11 counts of grand theft by false pretenses. These felony charges have also been subjected to sentencing enhancement allegations concerning white collar crimes totaling more than $500,000 and $1.3 million. Mr. Ebadat was held on $3 million bail and is due in court on January 15, 2013.
Out of the ordinary criminal charges often bring large amounts of news coverage due to the seemingly sensational topic of the crime. Unfortunately, this can often lead to defendants being portrayed in a guilty light long before trial has even begun and many in the public distrusting those who have been charged with white collar crime, whether or not they have been found guilty. It is important for all members of society, including reporters, jurors, and casual viewers alike to remember that a person is innocent until proven guilty in a court of law – not the other way around.
