The Honorable Herman Dawson issued an award, in favor of the firm's client, after an in-person hearing was conducted. The decision overruled a determination by the Department of Labor that the employee was not entitled to unemployment benefits because she voluntarily separated from her employer, without "good cause." The decision also overruled the Department of Labor's determination that the claimant must repay benefits previouslly received. Specifically, the decision set forth the following:
DECISION: The initial determination disqualifying the claimant from receiving benefits, effective April 17, 2012, on the basis that the claimant voluntarily separated from employment without good cause, and charging the claimant with an overpayment of $810 in benefits recoverable pursuant to Labor Law Section 597 (4), are overruled.
