The cost to defend medical malpractice lawsuits has increased over the last three years, however, the awards have been smaller and the number of claims is less according to the National Practitioner Data Bank. The author of this blog serves on a lawsuit claims committee for a national malpractice insurance company and can support these trends.
The reasons for this improvement in the medical malpractice lawsuit arena are unclear. There are only a handful of states that have been able to pass significant tort reform legislation. In two states, tort reform legislation was rescinded by the courts. It is clearly in the best interest of patient access, and cost of care, that these trends continue.
