Turner Law Offices Announce Filing Of A Lawsuit Against Fidelity Bank (Atlanta) For TCPA Violations

Complaint Alleges That Bank's Calls To Plaintiff's Cell Phone Violated The Telephone Consumer Protection Act (TCPA).

ATLANTA, GA--The law firm of Turner Law Offices, LLC has filed a lawsuit against Defendant Fidelity Bank (Atlanta) in the United States District Court for the Northern District of Georgia. The action is captioned Jennifer Blake v. Fidelity Bank, and is numbered 12-cv-3802.

According to the Complaint, Fidelity Bank violated the Telephone Consumer Protection Act ("TCPA") by using automatic dialing systems and an artificial or prerecorded voice to contact Ms. Blake on her cellular telephone about a purported debt of her Husband, without her prior consent. As described in the Complaint, Ms. Blake was repeatedly contacted since February, 2009 on her cellular telephone about the purported debt. The Complaint states that Ms. Blake never consented to those calls, nor did she voluntarily provide Fidelity Bank with her cellular telephone number.

Under the TCPA, Fidelity Bank could be ordered to pay statutory damages of $500 for each negligent violation, and/or up to $1,500 for each knowing and/or willing violation.
