Defense Files Rule 20 Motion in Baby Gabriel Case

The defense in the Elizabeth Johnson-Baby Gabriel Case filed a motion for Rule 20 today in the Superior Court of Arizona.

The defense in the Elizabeth Johnson-Baby Gabriel Case filed a motion for Rule 20 today in the Superior Court of Arizona. Ms. Johnson's attorney Marc J. Victor of the law firm Marc J. Victor P.C. filed the motion pursuant to Rule 20 for: Allegation of Dangerous Crimes Against Children.

The trial began Sept. 20 with testimony from the baby's father, Logan McQueary, who recorded his phone calls with Johnson and took them to Tempe police.

Johnson, 26, is charged with kidnapping, custodial interference and conspiracy in the December 2009 disappearance of her son, Gabriel. The child has not been found. Johnson has not been charged with murder. Because the child was last seen in Texas, she could not be charged with murder in Arizona.

The Judge in this case will rule on this Motion on October 15th when the trial is set to begin again.
