Oct. 4, 2012 - PRLog -- Due to the massive and pervasive overcrowding in federal prison, defendants are more and more being sent to prisons far, far away from their homes and families. Many times defendants who live in Florida, for example, are serving their sentence in California, Oregon, Wisconsin, or New York—places that are thousands of miles from their homes. Other inmates sentenced in California are being sent to Georgia, Kentucky, or West Virginia to fulfill the term of their imprisonment. This results in fewer visits, less time with loved ones and family members, and less time with children and friends. What can be done?

Mandatory minimum sentences, the rise in white collar crime, longer prison sentences, co-conspirators in the same case, CIMS cases, a backlog of prosecution cases, and probation violations are causing defendants to be sentenced farther and farther from their homes and families. More prisons are being built but they are not being built fast enough.  Frankly speaking, there are not enough federal prisons to house the current inmates let alone the huge logjam of federal defendants heading for prison.

What Can an Inmate Do?

   Mr. Frantz stated, “If an inmate or inmate’s family wants a transfer closer to their home or a transfer to a facility for a sentence reduction program http://jailtimeconsulting.com/RDAP-drug-program.php, or any type of transfer, they will need assistance.” A Nearer Release Transfer is a transfer for the purpose of placing an inmate currently in a federal prison nearer his release destination or his home. These transfers move the inmate closer to his legal residence as indicated in his Pre-Sentencing Investigation Report (PSR) or release destination. Families and inmates now need professional help because of prison overcrowding and the Bureau of Prisons’ catch all phrase of “population management” in denying inmate initiated transfers. No more can federal defendants rely on being initially designated within 500 miles of their release residences. Inmate transfers are more and more necessary.
