According to Drake, some important things to keep in mind with respect to Pre-Issuance (Third-Party)
• Submissions of patent and printed publications to be considered during patent examination permitted as of September 16, 2012
• Submissions must be made before the first office action rejection is mailed or within 6 months from publication of the patent application
• Submission must identify items being submitted along with a concise description of the relevance of each item listed
• If 3 or fewer items are submitted, there is no filing fee; if up to 10 items are submitted, there is a filing fee of $180
